May 4, 2021 The Honorable Thomas R. Carper Chairman, Committee on Environment and Public Works United States Senate Washington, DC 20510

Dear Mr. Chairman:

The U.S. Nuclear Regulatory Commission (NRC) is publishing the following document in the Federal Register:

Title:

Criteria to Return Retired Nuclear Power Reactors to Operations [PRM-50-117; NRC-2019-0063].

Description of the document: The NRC is denying this petition for rulemaking (PRM) because no significant safety or security issues were identified, and the existing regulatory framework may be used to address the issue raised by the petitioner. In addition, the nuclear industry has not expressed a strong interest in returning retired plants to operation, and therefore developing a new regulatory process for reauthorizing operation of decommissioning reactors would not be a prudent use of resources.

Dates: The docket for the petition will be closed on the date of publication in the Federal Register.

For more information, see the enclosed document.

Please contact me at 301-415-1776 if you have questions or need more information.

Sincerely, Eugene Dacus, Director Office of Congressional Affairs

Enclosure:

Federal Register notice cc: Senator Shelley Moore Capito
