The proposed amendments are desigred to assur' that those licensees requiring the greatest expenditure of Comission resources pay the greatest annual fee and to increase the total fees collected to an amount that equals at least 45 percent of the Comission's fiscal year 1988 budget as required by the Omnibus Budget Reconciliation Act of 1987. i The fees charged under Part 170 are designed to recover the agency's costs which are Jirectly attributable to an identifiable licensee such as license application reviews and inspections. These fees are as.horized by tv.e Independent Offices Appropriation Act of 1952. The annual fees charged under Part 171 are designed to recover generic costs applicable to all nuclear power reactor licensees but not directly attributable to a specific licensee such as research and rulemaking. These fees are authorized by the Consolidated Omnibus Budget Reconciliation Act of 1985. As proposed, the amendments would: (1) remove the Part 170 fee ceilings for reactor, fuel cycle facility, transportation cask packages and shipping container application reviews and inspections; (2) revase the hourly rate for NRC professional time spent providing various regulatory services and provide for annual adjustment; (3) revise upward the ceiling on annuai charges in Part 171; (4) include, when appropriate, reimbursements from the Department of Energy Nuclear Waste Fund; (5) charge for each routine and nonroutine inspection conducted by the NRC staff; (6) remove amendment application fees for reactor facilities and reactor-related reports; and i l l ,..m (7) remove the application fee and permit deferral of review and certification fees until a standardization design is referenced. ALL PARTS 30, 40, 50, 61, 70, 71, 72 AND 13 LICENSEES, APPLICANTS AND PEACTOR VENDORS
SUBJECT:
PROPOSED REVISIONS TO 10 CFR 170 AND 171 ON LICENSE AND ANNUAL FEES Gentlemen: i On June 27, 1988, the U.S. Nuclear Regulatory Comission published in 1 the Federal Register (53 FR 24077) for public coment the enclosed Notice of Proposed Rulemaking. This notice proposes revisions to the fee requirernents of 10 CfR l70 ("Fees for Facilities and Materials + Licenses and Other Regulatory Services...") and 171 ("Annual Fee for Power Reactor Operating Licenses"). These revisions am being made to update the Current fees and to implement Section 560l of the Omnibus Budget Reconciliation Act of 1987 (Public Law 100-203) enacted by the Congress. The fee legislation requires the Comission to collect under 10 CFR 170 and 171, as well as under other provisions of law, not less than 45 percent of its costs for each of fiscal years 1988 and 1989, i Coments should be submitted by July 27, 1988. The NRC staff will hold d public meeting questions on Julyto 7 discuss the proposed changes and to answer any 1988, at 3:00 p.m. in Room 2F-17 at the NRC's White Flint North Building,11555 Rockville Pike, Rockville, Maryland. , l The major changes proposed to Parts 170 and 171 would:-
- 1. Part 170:
a. Remove the fee ceilings for reactnr and major fuel cycle permits, licenses, amendments and inspections. l l
- b. Revise the hourly rate in 10 CFR 170.20 for NRC professional staff time spent providing various regulatory services and provide for an annual adjustinent. i
- c. Charge for all routine and non-routine inspections; the current maximum billing frequency is betr.g ei tminated.

- d. Remove the application fee for reactor facility license amendments and other approvals, as well as for reactor related reports,
- e. Remove the application fee for standardized Jesign approvals and defer payment of costs for standardized reactor design reviews and certifications until the standardized design is referenced.
- 2. Part 171:
Revise upward the annual fee ceiling and change the method of allocating costs so that those licensees requiring the greatest expendiure of NRC resources would pay the most fees. In addition to the above, the notice being published solicits your coments on a second option. Under this option, the Comission at this tine would not adopt any chanijes to Part 170 or Part 171 other than to raise the annual fee so that the amount of fee collected by the Comission uncer 10 CFR 171.15, when added to fees that would be collected under 10 CFR 170 as currently codified, would approximate, but not be less than 45 percent of the NRC budget.
