Dear Members of the Board:

In the transmittal' letter accompanying CCANP's Proposed Findings of Fact and Conclusions of Law in the Form of a Partial Initial Decision, I stated that I believed that there would be no prejudice to the NRC Staff from the overnight delay in the delivery of our proposed findings because NRC Staff-counsel was too busy working on his own findings to have had time to look at ours. That statement was entirely too glib and inappropriate.

Obviously, there arc ather members of the NRC Staff who could have been reviewing our proposed findings. Clearly, Mr. Reis and Mr.Perlis are active in this case. ,

Furthermore, it is not my place to speak to how busy NRC Staff counsel is or on what.

I apologize to Staff counsel for my glibness and give thanks that the process of writing and producing ou'. proposed findings is over. Should the NRC Staff consider itself in any way prejudiced by the overnight delay in delivery, certainly CCANP would not oppose a one day extention in their time (and Applicants' time) to file their propo/ sed findings.
