REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE, V. C. SUMMER NUCLEAR STATION

Dear Mr. Sepp,

Westinghouse's July 25,1997, application and affidavit submitted WCAP-14932, "Prcbabilistic and Economic Evaluation of Reactor Vessel Closure Head Penetration Integrity for Virgil C.

Summer Nuclear hant" to us, and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. My July 16,1998, letter to Mr. N. J. Liparulo at Westinghouse indicated that some of the material may be withheld in accordance with 10 CFR 2.790(a)(4), but that certain other material should be released and placed in the Public Document Room (PDR). Your August 26,1998, letter to me concluded that we could release the WCAP-14932 material to the FDR, as I requested. You also stated that you would send us Revision 1 of proprietary WCAP-14932 and Revision 1 of non-proprietary WCAP-14955 in order for us to do this.

Your February 16,1999, application, and affidavit signed by James M. Brennan, submitted proprietary WCAP-14932, Revision 1, "Probabilistic and Economic Evaluation of Reactor Vessel Closure Head Penetration Integrity for Virgil C. Summer Nuclear Plant" to us, and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790(b)(4). Your reasons for requesting our withholding of this information were as follows:

I I (a) The information reveals the distinguishing aspects of a process (or component, g structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies. .

(b) It consists of supporting data, including test data, relative to a process (or /

component, Ftructure, tool, method, etc.), the application of which data secures a competitive economic advantage, e.g., by optimization or improved marketability.

(c) It reveals cost or price information, production capacities, budget levels, or commercial strategies of Westinghouse, its customers or suopliers.

We have reviewed your application and all of the supporting information in accordance with the requirements of 10 CFR 2.790 and my July 16,1998, letter. On the basis of your statements, we have determined that the submitted information sought to be withheld cmtains proprietary commercial information and should be withheld from public disclosure.

public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

l l Withholding from public inspection shall not affect the right, if any, of pe; sons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultanta working in this area. We will, of course, ensure that the consultants have signed the sppropriate agreements for handling proprietary information.

If the basis for withholding this information from public disclosure should change in the future, such that the informat,on could then be made available for public inspection, you should l promptly notify us. You should understand that we may have cause to review this determination in the future (e.g., if the scope of a Freedom of Information Act request inclucas your withheld information). In all review situations, if we make a determination adverse to the above, we will notify you in advance of any pubile disclosure.
