MOTION FOR RECONSIDERATION Attorney General Francis X. Bellotti hereby moves the Licensing Board to reconsider its Memorandum and Order of July 25, 1986, to the extent that such Order dismissed without any consideration certain objections to Applicants' Motion for Issuance of Operating License for Operation Not in Excess of 5%

Rated Power (hereinafter " Applicants' Motion"] raised by Attorney General Bellotti in his Answer to Applicants' Motion filed July 2, 1986.

In his Answer, Attorney General Bellotti set forth ten numbered objections to Applicants' Motion.

Five of those objections (11 1, 2,

4, 5 and 6) were the subject of a Petition of Attorney General Francis X.

I the Seabrook Licensing Proceeding [ hereinafter " Petition of Attorney General Bellotti").

These objections were all addressed by the Board in its Memoranda of July 25 and July 30, 1986, at least to a limited extent.

However, Paragraphs 3, 7, 8, 9 and 10 of Attorney General Bellotti's Answer set forth other objections which are not a challenge to Regulation 50.47(d) and which the Board's Order does not address.

Attorney General Bellotti therefore respectfully requests that this Board reconsider its Order of July 17, 1986 insofar as it fails to consider all objections to Applicants' Motion raised by Attorney General Bellotti and in particular to reconsider its Order insofar as it would allow issuance of an operating license for operation not to exceed 5% of rated power prior to:

)

(a) the submission of radiological emergency response plans of all state and local governmental entities within the Seabrook Station emergency planning zone as required by 10 C.F.R.

S 50.33(g), see Answer of Attorney General Bellotti at 1 7; j

(b) the filing of a supplement to the Final Environmental Statement for Seabrook Station filed in December, 1982, as required by 10 C.F.R.

S 51.72 to account for the significant new circumstances and information (set forth in Attorney General Bellotti's Answer) relevant to environmental concerns and bearing on the operation of the Seabrook plant at full and low power, see id. at 1 8;.-

N (c) there being in place the design number of notification sirens in all communities within the plume exposure EPZ and procedures and adequate communication equipment for notification by the licensee of the Massachusetts local response organizations as required by 10 C.F.R.

S 50.47(b)(5).

See id. at 1 9 and 47 Fed. Reg. 30232, 30234 (July 13, 1982); and (d) the parties having an opportunity to appeal the dismissal and summary disposition of contentions filed in this proceeding on which, pursuant to Section 189a of the Atomic Energy Act, a hearing is required prior to issuance of low-power operating license, see Answer of Attorney General Bellotti at 1 3.

Attorney General Bellotti further requests that the Board reconsider its Order of July 17, 1986 insofar as it fails to address 1 10 of Attorney General Bellotti's Answer objecting to 1 C(6), the " Emergency Preparedness" provision, of the draft low power license for Seabrook Station proposed by the NRC Staff.
