PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Connission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about October 12, 1988 to Omaha Public Power District. This action is based on two violations identified by the licensee. One violation involves the installation of improper check valves in instrurent air accumulator lines to level instruments. The excessive leakage found during testing could have resulted in the premature transfer of purp suction sources from the Safety injection and Refueling Water Tank to a potentially dry containment Sump in the event of a LOCA and loss of the nonsafety-related instrument air system. The second violation involves the failure of plant sersonnel to install a test cap on a containment pressure sensing line (3/8 inc1 line) after testing. This resulted in a open pathway from the containment. Both violations involved the failure to promptly identify and correct significant problems although NRC inspectiona had indicated deficiencies in these areas. The escalation and mitigation factors of the Enforcement Policy were considered and no adjustment was considered appropriate.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Following NRC evaluation of the response, the civil penalty may be ret 'tted, ,
