Thank you for your letter dated May 29, 1985, expressing concern with the requirement for remitting a $150 application fee with each topical report submitted for review. As an alternative, you suggested that your company be permitted to guarantee the minimum unreturnable $150 payment in the letter transmitting the report.

We appreciate your concern with the application fee for actual cost applications and will tako into consideration your concerns, along with those of others, in our next revision of 10 CFR 170.

It is expected that Part 170 will be reviewed and revised as necessary in 1986. However, at present,10 CFR 170.12(a) does not permit the relief you request. As an alternative suggestion, perhaps on a semiannual or annual basis, your company could make payment of a given amount (e.g., $1,500) based on your anticipated submittal of reports during that semiannual or annual period. This would only require that your company provide us a copy of the letter that tran::mits your initial payment and subsequently provide us a copy of each letter transmitting the report or revision for review.

Any unused sum remaining at the end of the semiannual or annual period could be applied to review costs for a particular report.

Since 170.21.J is the basis for fees for topical and other reports and revisions to reports, Part 170, along with your company's letter which transmits the report or revision to NRC for review, may provide a sufficient record for the auditing process.
