Dear Mr. Lochbaum:

l Thank you for your letter of February 1,1999, in which you express concern regarding the independent review of the Office of the Inspector General (OlG) Event inquiry (Case No.99-01S) on the "NRC Staff's Handling of Harassment and intimidation (H&l)

Complaints at Millstone *, la particular, you have questioned whether any U.S. Nuclear Regulatory Commission (NRC) employee, other than those within the Office of the inspector General and the Atomic Safety and Licensing Board Panel, can truly serve on the independent review team without an inherent conflict of interest.

l As you know, on January 28,1999, on behalf of the Commission,1 directed an independent review to assess the merits of the cases addressed in the OlG Event Inquiry and an additional l case, and to formulate lessons learnad from the NRC staff's handling of the cases and offer recommendations for improving investigative and enforcement processes. This review was led by Judge G. Paul Bollwerk, Ill, Ac+Jng Chief Administrative Judge of the Atomic Safety and Licensing Board Panel, who reports direc;ly to the Commission and is entirely independent of

, the rest of the NRC staff. Judge Bollv.erk was assisted by Sara McAndrew, an attorney with the NRC Office of the General Counsel; and Carolyn F. Evans, Regional Counsel, NRC Region ll.

In addition, Alan S. Rosenthal, former Chairman, General Accounting Office Personnel Appeals Board, and former Chairman, NRC Atomic Safety and Licensing Appeal Panel, and Gary K. f Hamer, Supervisory investigator, U.S. Office of Special Counsel, served as expert advisors to [/f the independent review group All of these individuals have had no prior involvement ire the Millstone cases under scrutiny.
