Dear Ms. Luxton:

Thank you for your letter of February 11,1999, in which you express concern rega; ding the independence of the review of the Office of the Inspector General (OlG) Event Inquiry (Case No.99-01S) on the "NRC Staff's Handling of Harassment and Intimidation (H&l)

Complaints at Millstone."

As you know, on January 28,1999, on behalf of the Commission, I directed an independent review to assess the merits of the cases addressed in the OlG Event inquiry and an additional case, and to formulate lessons learned from the U. S. Nuclear Regulatory Commission (NRC) staff's handling of the cases and offer recommendations for improving investigative and enforcement processes. This review was led by Judge G. Paul Boilwerk, Ill, Acting Chief Administrative Judge of the Atomic Safety and Licensing Board Panel, who reports directly to j

the Commission and is entirely independent of the rest of the NRC staff. Judge Bollwerk was assisted by Sara M%ndrew, an attorney with the NRC Office of the General Counsel; and Carolyn F. Evans, Regional Counsel, NRC Region ll in addition, Alan S. Rosenthal, former Chairman, General Accounting Office Personne! Appeals Board, and former Chairman, NRC Atomic Safety and Licensing Appeal Panel, and Gary K. Hamer, Supervisory Investigator, U.S.

Office of Special Counsel, served as expert advisors to the independent review group. All of these individuals have had no prior involvement in the Millstone cases under scrutiny. As such,

With respect to dispositioning your suggestions for the independent review, I forwarded a copy j

of your letter to Judge Bollwerk for consideration in his review.
