Dear Mr. Murphy:

This is to infom the Joint Comittee of an amended license application.

No. XSNM-805, recently filed with the Nuclear Regulatory Comission under circumstances which make it possible that an export license for the fuel involved will be issued shortly. As you know, the Comission has been considering for some time applications for licenses to export fuel for the Tarapur Atomic Power Station in India. The Comission decided in an opinion published May 7th to conduct a legislative-type hearing in this matter. The three organizations which had initiated consideration of a hearing recently sought to have the hearing which had been scheduled by the Comission postponed from the date first set (June 2,1976) until i

July, in order to permit the preparation which they believed necessary.

The Comission's original hearing date had been set, in part, in recognition of assertions made by the Department of State that available feed stock 3

of nuclear fuel already in India would shortly be exhausted.

XSNM-805 (approximately 40% of the total now under liceqse application i

and representing a few months' supply) would permit tho' requested delay without " jeopardizing the Indian requirements for electrical power."

i The groups which had sought the extension, in turn, agreed that they would i

make no further objection to the issuance of this particular license, in the interest of obtaining the time they felt was required to conduct a 1

more meaningful examination of the issues, so long as it was understood that by this act they waived no legal argument concerning the remainder 8

of the fuel. With these understandings in hand, the requested extension i

of time was granted. The State Department paper and the order granting the extension are attached.
