Dear Mr. Loux:

On January 7, 1983, the President signed into law the Nuclear Waste Policy Act of 1982 (NWPA). The Act established a process defining the roles of the President, the Congress, the affected States and Indian Tribes, the Department of Energy (DOE), the Nuclear Regulatory Commission (NRC), and other Federal agencies in the siting, construction, and operation of a geologic repository for the permanent disposal of high-level nuclear waste. Put into very simplistic terms, DOE has, responsibility for screening and characterizing site (s) for a repository, reccmmending a site for repository development, and obtaining an NRC license for the site approved by Congress and the President.

DOE also has the responsibility for constructing, operating and decommissioning the facility. The NRC is responsible for determining whether to license the facility at the selected site, and assuring that it will be constructed and operated without unreasonable risk to public health and safety, and in accordance with the Environmental Protection Agency's standards for the disposal of high-level waste.

Consistent with our role under the NWPA, we intend to work to assure that potential licensing issues are identified, and addressed by DOE, early in the process and that DOE has complete, well-validated documentation for each part of the application it will eventually submit for the site of its choosing. In order for the national waste program to have credibility it must De characterized by openness between DOE, NRC, States, and Indian Tribes. All interested parties must have timely access to information, identification of issues, and actions to address issues. As part of the continuing and early exchange of data between DOE, NRC, States, and Indian Tribes, NRC will be holding a meeting on April 29-30, 1986, in Las Vegas, Nevada. The purpose of g the meeting is to discuss a number of initiatives developed by NRC to

- o streamline the high-level waste repository licensing process, as well as to "r provide demonstrations of NRC's " pilot prd ects" for the licensing support and O the open item tracking systems. The agenda and documents to be discussed c

m at the meeting are attached. We have invited representatives of both the

c 1 NWPA' To prevent any confusion, we want to note that the NRC meeting on April 29-30 is independent of the DOE /NRC meeting taking place on April 22 in Washington, D.C. The April 22 meeting is a DOE /NRC Licensing Support System Coordinating Committee. meeting. This is a committee concerned with coordinating DOE technical efforts to develop a document management system to suppcrt the licensing hearing for a high-level waste repository with NRC, States, and Indian Tribes. DOE is sending separate announcements for this meeting. The meeting will deal only with the technical activities of NRC/ DOE on the document management system. The NRC meeting on April 29-30 will deal with the document management system as well as other NRC activities concerning the high-level waste program.

The NRC meeting on April 29-30 will take place in Las Vegas, Nevada, at the Alexis Park Hotel located at 375 East Harmon Avenue. The hotel was already booked for the days of the meeting so all those attending must make their own room arrangements at the hotel of their choice. The conference room for the meeting will hold up to 100 people. Please limit the number of participants from each State or Tribe to two people. Since the " pilot projects" utilize data from the Nevada site, we thought it would be useful to hold the meeting in Las Vegas. This would also give DOE staff from the NNWSI Project Office the opportunity to use the system and give us their feedback. We have reserved the afternoon of April 30 for this activity.
