20555 Re: Appeal from an Initial FOIA Decision FOIA-84-559

Dear Gentlemen:

is This to appeal the partial denial of my request for information pursuant to the Freedom of Information Act, 5 U.S.C.

522.

On August 14,1985 I recieved a letter from you denying part of my request for access to the following:

(1) all legally-binding agreements and/or informal commit.ments made by the Department of State regarding the Philippine Nuclear Power Plant-1, as well as the text of any such agreements or commitments.

(2) all communications by the Department of State regarding the Philippine Atomic Energy Commission including but not limited to those specifically in connection with the Final Safety analysis Report on the Philippine Nuclear Power Plant-1.

(3) all communications received and/or sent between the Department of State with Mr. Bartholome Ziola current head of the Philippine Atomic Energy Commission.

(4) all communication received and/or sent between the Department of State Mr. Ibe, former head of the Philippine Atomic Energy Commission.

I am enclosing a copy of this partial denial along with copies of my original request.

I trust that upon examination of these communications you will conclude that the information I am seeking should be dis-closed.

As provided for in the Act, I will expect to receive a reply within 20 working days.

If you decide not to release the requested information, I plan to take this mattet to court.
