l SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION '

SUPPORTING AMENDMENY NO. 9 TQ FACILITY LICENSE NO. TR-2 CBS CORPORATION ACTING THROUGH ITS WESTINGHOUSE ELFCTRIC COMPANY DIVISION

1.0 INTRODUCTION

By letter dated September 28,1998, as supplemented on November 17,1998, the CBS Corporation applied for an amendment to the possession only license of the Westinghouse Test Reactor (WTR) to request that the name of the licensee for the WTR be changed from CBS Corporation Acting Thrcuch its Westinghouse Electric Company Division to simply the CBS Corporation.

2.0 EVALUATION CBS Corporation Acting Through its Westinghouse Electric Company Division is the licensee for the Westinghouse Test Reactor (WTR) at Waltz Mill, Pennsylvania. The licensee is authorized to only possess the reactor and a decommissioning plan has been approved. The licensee is planning to sell most of its nuclear related facilities to other entities, but will retain the WTR One of the arrangements made with the purchasers of the other facilities is that the Westinghouse name will be conveyed with these f acilities, and because of this arrangement, the licensee requests that the license associated with the Westinghouse Test Reactor be changed to simply CBS Corporation, to elimate any reference to the name Westinghouse.

This corporate name change does not involve any change in the management, organization, location, facilities equipment, or procedures related to the licensed activities under the WTR license. The employees responsible for the licensed WTR fccility will still oe responsible either directly through the CBS Corporation or through contc9ctual airangements for which CBS Corporation is ultimately responsible, notwitSstanding the new name of the licensee.

In view of the above, the staff concludes that no substantive change to the licensee's arrangements or ability, qualifications, or responsibilities to possess or decommission the WTR will result from the name change. Therefore, the staff concludes that the amendment i

to reflect the name change of the licensee for the WTR is administrative in nature and should be approved.

3.0 ENVIRONMENTAL CONSIDERATION

Pursuant to 10 CFR 51.21,51.32, and 51.35, an environmental assessment and finding  ;

4.0 CONCLUSION

4 The Commission has concluded, based on the considerations discussed above, that: (1) 3 there is reasonable assurance that the health'and safety of the public will not be
