I agree with the staff that the final rule, as writton in SECY-98-294, could be interpreted to mean tnat the certified designs would now have to meet IEEE std. 603-1991 and could therefore be considered a potential backfit issue for combined license opplicants. I also agree with Commissioner McGarfigan that imposing a new requirement in such a manner would be counter to the Commission's intent to provide finality for standard designs. Thus, I believe the staffs clarification provided in SECY 99 061 is prudent I commend the staff for their prompt resolution of this matter.

The Commission approved a final rule which incorporates by reference a national consensus standard in 10 CFR 50.55a(h) that establishes minimum functional and design requirements for the power, instrumentation, and control portions of the safety systems for nuclear power plants.
The Commission approved the publication and implementation of this final rule, as provided in J
SECY-99-061, subject to the following change.
On page 4 on the Federal Reaister notice, line 3, delete the duplication of the words 'the use of'so the sentence reads: "In addition, the final rule mandates the use of the usc of IEEE Std. 603-1991 Following incorporation of the change, the Federal Reoister notice should be reviewed by the Rules Review and Directives Branch in the Office of Administration and forwarded to the Office of the Secretary for signature and publication.
