WITHDRAWAL OF PROPOSED IMPOSITION OF CIVIL PENALTY i
By EN 88-53, dated June 14, 1988, the staff notified the Comission that it
]
was proposing to impose a civil penalty in the amount of $50,000 to Comonwealth 3
Edison Company for violations relating to a failure to maintain control of L
access to a vital area of the plant.
The Notice of Violation and Proposed 3
imposition of Civil Penalty was sent to the licensee on June 17, 1988 and the i
i licensee responded to the Notice on July 22, 1988, requesting a reduction of a
the severity level and remission of the civil penalty. After reviewing the licensee's response and the facts of the case, the staff has determined that t
i although the violation occurred as stated in the Notice, the severity level of i
the violation would more correctly be categorized at the Severity Level IV l
j instead of Severity Level III as stated in the Notice.
In view of the fact that the severity level of the violation is now below that which normally would be considered for a civil penalty, the staff is 1
withdrawing the penalty proposed by the Notice. The licensee is being i
informed of this decision by letter.
