WITHDRAWAL OF PROPOSED IMPOSITION OF CIVIL PENALTY f i By EN 88-53, dated June 14, 1988, the staff notified the Comission that it

] was proposing to impose a civil penalty in the amount of $50,000 to Comonwealth 3 Edison Company for violations relating to a failure to maintain control of L access to a vital area of the plant. The Notice of Violation and Proposed 3 i imposition of Civil Penalty was sent to the licensee on June 17, 1988 and the i a licensee responded to the Notice on July 22, 1988, requesting a reduction of "

the severity level and remission of the civil penalty. After reviewing the t

licensee's response and the facts of the case, the staff has determined that ,

i although the violation occurred as stated in the Notice, the severity level of i the violation would more correctly be categorized at the Severity Level IV l j instead of Severity Level III as stated in the Notice.

In view of the fact that the severity level of the violation is now below  !

that which normally would be considered for a civil penalty, the staff is >

1 withdrawing the penalty proposed by the Notice. The licensee is being i informed of this decision by letter. l t
