is involved in a hearing in Ohio this morning.

5 Who are the parties being represented here today?

6 We will start with Applicants, proceed to Intervenors, go on 7

to Staff and FEMA.

8 MR. IRWIN:

for Long Island Lighting Company.

call but has authorized me to speak on his behalf.

2 JUDGE MARGULIES:

Thank you.

3 We have for discussion this morning the motion 4

filed by LILCO for a three-day extension to respond to 5

Intervenors' exercise contentions.

6 We received this morning a response of Suffolk 7

County, the State of New York, and the Town of Southampton 8

to LILCO's motion for extension of time to respond to 9 l exercise contentions.

10 We have before us a request for an extension, and 11 l Applicants spell out the problem involved, it being a

('

12 162-page document consisting of 50 separately numbered m

13 contentions containing approximately 175 subparts.

14 It is the intention of the Board that we want to i

15 see well-prepared filings, but they are to be of no value if 16 the Board does not have sufficient time to consider them, 17 and to state things very succinctly.

18 The Board has no problem with the proposed filing 19 dates in regard to the Applicants and to the Intervenors, 20 but we would need one additional week to prepare for the 0

21 i prehearing conference.

We would find that a conference on 22 September 3rd would be adequate and would fulfill the needs 23 i of everyone.

The County and the Town of 6

Southampton have no problem with that.

9 I would just like to note one thing.

I think 10 everyone is contemplating that this will be done in a 11 one-day conference.

In the event that it should go over to 12 Thursday, the 4th of September, Ms. Letsche and my other g

13 colleagues from here, we have an unavoidable conflict on the 14 4th, late in the afternoon on the 4th.

We would be 15 available until approximately 1:00 o' clock on the 4th.

16 After that time we would have to depart.

17 JUDGE MARGULIES :

Well, that seems to be a 0

I just wanted to alert you.

we would commence the hearing on Wednesday at 9:00 o' clock 8

l instead of the usual 9:30.

One other thing, the Board has 16 never gotten a copy of the FEMA report on the exercise.
