7 bne received ycur letter dated September 28, 1900. While your letter inaccuretely reflects portions of our conversation, I wish to take only the following observatier:s:

The tone of your letter suggests a belief cr. your part that the Urbanik studies, which I forwerded to the Licensing Board and parties in Aucust, are raterial to the issues before the Board and that they porterd substartial ham to ycur case -- prenpting your concern that the Boarc is rcw in possession of these materials. As I inforned you when we spoke, if your apparent belief as to the significance of these materirls is correct (as to which I express no opinion), I would have been remist 4r not providir.g them to the Board, pursuant to established Board notification obligations applicable to all parties in NRC adjudicatory proceedings.

It was your colleague. Alan Fierce, who repeatedly demandcd that I transmit the Urbanik studies to him -- in response to which I indicated that I would trar: snit the studies to all parties.
I den't share ycur apparent fear that the Licensing Ecard will irrproperly rely upon these materials in rendering its decision.
The Licensine Board is surely aware of its etligation te render a decision solely on the basis cf the existing record and hardly reeds a reminder ' rom either of us.
