to issue a Notice of Violation and Proposed Irposition of Civil Penalty in the i
1 amount of Fifty Thousand Dollars ($50,000) to Comonwealth Edison Company.
This j
action was based on three design control deficiencies which resulted in the i
Control Room Ventilation System being degraded.

.i The licensee responded to the Notice in letters dated June 20, 1988 and October 6, j
1988. After careful consideration of the licensee's response, the staff has concluded that two of the violations did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty. The third violation was modified to properly reflect the date after which the licensee performed certain j
testing but this modification of the Notice did not affect the material issue.

Accordingly, an Order Imposing Civil Penalty in the amount of $50,000 has been i
1 issued today. Under the tenns of the Order, the licensee may within 30 days of j
the date of the Order, pay the civil penalty or request a hearing.
