Good afternoon, ladies and gentlemen.

We have four items before us for affirmation toaay.

We will ask the Secretary to summarize the items and I believe we need a vote, too, do we not?

SECRETARY CHILK:

Yes.

On the affirmation of SECY-86-221, the Braidwood Draft Order, I wonder if I could have a vote to hold that on less than one week's notice.

SECRETARY CHILK:

Thank you.

In this paper,86-221, Braidwood, draft order taking Commission review of subpoena issuance.

The Commission is being asked to intervene in an adjudication to resolve a dispute over whether the Braidwood Licens:ng Board issuance of a subpoena to a particular individual would compromise an ongoing investigation by the Office of Investigations.

The order before the Commission directs the Licensing Board to certify the relevant record to the Commission as provided in the 1984 Commission policy statement and to refrain from taking the action contemplated in the Board's July 22, 1986 notice of intent pending Commission disposition of the matter.

All Commissioners have approved the order which was attached to our memorandum of today as modified by comments from Commissioners Anselstine and Roberts.

The second paper is86-168, final revision of 10 CFB'Part 35, nedical use of byproduct material.

In this paper the Commission is being asked to approve a final revision to CFR's on this subject.

All Commissioners have approved the revised Part 35 subject to the modifications that were contained in the attached draft SRM to the staff which is attached to our memorandum of July 28.

The modifications require that all misadministrations resulting in a whole body dose areater than 500 millirem or an organ dose of two rem should be r,eportable to the NRC and the patient's attending physician.

Also, the modifications require prior NRC approval for changes in procedures which are potentially important to safety.

The third item is EECY-86-203, the Aamodt application for reimbursement for participation in the TMI restart proceeding.

The Commission here is being asked to act on an order responding to an application to the Commission from Marjorie and Norman Aamodt for the award of attorney's fees and costs under the Eaual Access to Justice Act for their

carticipation in the Three Mile Island Uni t One Restart Proceeding.

All Commissioners have approved an order attached to memorandum of;3uly 28th denying the Aamodt's petition and our citing a recent court action ruling that Section 502 of the Commission's Appropriation Act prohibits the payment at this award to intervenors in an NRC proceeding.

The fourth and last item is SECY-86-184, Emurgency Planning, Medical Services.

Here the Coimmission is acting on a policy statement in an order in response to a GUAPD remend.

All the Commissioners have approved the policy statement and the order attached to our memorandum of July 31st in response to the remand.

The policy order indicates that the Commiesion believes that 10 CFR bO. 4/ (b) (12) requires pre-accident arrangements for medical services tor individuals who might be severely exposed to dangerous levels of offsite radiation following on accident at a nuclear nlant.

To fulfill this mandate the SRM will direct the staff to issue approcriate guidance to the licensees and applicants which implements the policy utatement.

The order remandt this matter back to the $:af ety and Lic nsing Board and ctates th at it should bo hold in abeyance

5 until issuance of the staff's detailed generic guidance,an the planning standard.

Upon receipt of that guidance, the Board should initiate appropriate proceedings to consider the adequacy of the applicants emergency medical arrangements.
