Request for an Emergency Technical Specification Amendment to Restart Fermi 2 On July 2, Detroit Edison requested exigent processing of an amendment to the Fermi 2 Technical Specifications as indicated in Reference 3 above.

Ms. Elinor Adrnstm July 30, 1986 VP-86-0112 Page 2 On July 22, the Federal Register contained a notice of proposed amendment and determination of no significant hazards consideration (51 FR 26319).
The Federal Register notice indicated that comments would be accepted through August 6, 1986.
The Technical Specification amendment will change the Division I degraded grid relay and time delay setpoints.
As such, the requested amendment is necessary prior to restart of Fermi 2.
On July 30, 1986, the NRC held a public meeting at Detroit Edison to consider restart of Fermi 2.
The NRC indicated

that concurrence for restart could come as early as July 31, 1986.
If such concurrence comes during the aforementioned Federal Register Notice period, Detroit Edison requests that the subject amendment be handled under the emergency provisions of 10 CPR 50.91.
10 CPR 50.91 states "where the Commission finds that an emergency situation exists, in that failure to act in a timely way would result in... prevention of... resumption of operation..., it may issue a license amendment involving no significant hazards consideration without prior notice and opportunity for a hearing or for public comment."
Reference (6) provided the basis for concluding that Detroit Edison had applied for this amendment in a timely fashion, that it could not have avoided this situation and that it has not created the exigent condition.
In conclusion, Detroit Edison requests that the Technical Specification amendment requested by reference (3) be processed as an emergency change as soon as possible following concurrence by the NRC to restart Fermi 2 if such concurrence comes during the Notice period.
