a 6#W in a, memorandum dated September 13, 1978, Ccrmissioner Gilinsky ncted that the Commission's export licensing regulations, 10 CFR Part 110, to not explicitly. detail all the Com=is sion 's internal review procedures concerning those applications reviewed by Commissioners, but which are not subj ect to public proceedings.

The memo also cuestioned whether the failure to Spell out these procedures violated the Nuclear Non-Prs liferation l

Act.

Section 304(b) of the NNPA provides, "The Con ~ission shall m

pro =ulgate regulations establishing procedtres for the granting, suspending, revoking or coending cr.any export ideense er exemption pursuant to its statutory authority".

The Office of the General Counsel believes tha the present NRC regulations are sufficiently detailed to comply with the recuire-ments of the NNPA.

However, we believe it would be useful for the Commission to adopt additional.., internal review procedures to clarify how the Commission wi$1. breach its final tecision to accep; er rejet: the staff recomilhd3 icn on an expor: license application.

The Commission's handling of expert licensing differs from its domestic licensing responsi'cilities in that 5:atutcry deadlines are placed on Commissioner review and

If the Commission has not acted en the application within c0 days after receipt of Executive 3 ranch views, the NRC staff must write to the applicant explaining the delav.

If the Commission does not act within an additional 6'O

. days, the President can find that the delay is excessive j

and authorice the export by executive order.

The 120 day total time period,.is extended if the Commission holds public hearings, or reouests further information from the Executive Branch within 60 days after receipt of Executive Branch views.

In such cases, the Commission has 60 days to act after public hearings are completed or the additional information'is obtained.
