Dear Dr. Murley ,

I Thank you for your letter of February 20, 1987 suggesting a meeting regarding a restart of the Pilgrim reactor.

It has been more than seven months since we submitted our petition for~Show Cause. To date, the Nuclear Regulatory Commission has f ailed to respond to critical technical or management de-ficiencies cited by that petition. Nor has the Commission scheduled a public hearing to determine whether Boston Edison's license to

operate should be suspended or revoked.

The Commission's f ailure to respond to these issues in either a. timely or substantive manner is unacceptable. Your close and continuous communication with the licensee stands in sharp contrast to the manner in which you disregard the petition submitted by elected public of ficials and interest groups. Frankly, this attitude calls into question the willingness of the NRC to act as the neutral-forum for the resolution of public safety issues envisioned by Congress in its enabling legislation.

Unless the issues raised in the July 15, 1986 petition for Show Cause are addressed, and a hearing scheduled prior to a restart of pilgrim, we must conclude that the NRC has, prejudged our petition and denied its contentions on a de f acto basis without a full and fair opportunity for the petitioners to be

-heard.

In response to your recent letter, there are several questions which must be addressed prior to our agreeing to meet.

First, it is not c1. car from your letter with whom you intend to meet. Is it your intention to meet with all the co-petitioners or a smaller group? Would the licensee be invited to attend?

9 page 'l Second, who will represent the NRC in this meeting? We cannot determine from your letter whether or not NRC personnel qualified to respond to technical issues will attend. Will we be able to ask questions of staf f ? What specific issues are to be discussed at this meeting? Do you intend to generate a transcript of this meeting?

What relationship will this meeting have to the NRC's formal response to our petition for Show Cause? We eagerly await the report of Boston Edison documenting its ef fort to improve conditions at Pilgirm. The licensee's report, however, is no sub-stitute for an NRC response to substantive issues raised in our petition. It is the responsibility of the NRC to respond to our inquiry. As a matter of common sense, and a matter of law, the licensee cannot substitute its action for that of the Commission.

We would deeply appreciate clarification of the issues referred to in this letter by March 25, 1987.
