Dear Members of the Acorn Alliance:
Your petition (transmitted by your letter of June 25,1986) requesting that the Nuclear Regulatory Commission hold a formal public hearing in Humboldt County during the expanded comment period on the Draft Environmental Statement for decomissioning Humboldt Bay Power Plant, Unit No. 3 (DES), has been received. It is also noted that your petition requests an extension of the public coment period for an additional three months beyond the original cut-off date of June 16, 1986.
As you indicate in your cover letter, you are aware that the public comment period on the DES has been extended an additional 60 days, to August 15, 1986,
- for a total of 105 days for public comment. It does not appear that a further extension is warranted, and no additional extension is contemplated.
Although the interest expressed in your petition for a public hearing during the coment period on the DES is appreciated, the Nuclear Regulatory Comission (NRC) does not intend to hold a public meeting for the purpose of receiving comments on the DES. Rather, the public is encouraged to provide written coments to the NRC by August 15, 1986. Such comments will appear verbatim in the Final Environmental Statement (FES) along with our responses and appropriate revisions to the DES. In addition, each comentor will receive a copy of the FES when it is issued. In this manner, all individuals who provide written comments will receive equal treatment.
.' A public hearing, in the context of the NRC Regulations, is a formal adjudicatory process, before an Atomic Safety and Licensing Board (ASLB).
Such a hearing is held regarding the licensing action proposed (the approval of the Decommissioning Plan and granting of the amendment to the license), not the Environmental Impact Statement (DES or FES). The FES, among other material, is offered in evidence by the NRC Staff at such a hearing, and is subject to cross-examination by the parties to the proceedings. The procedure for requesting such a public hearing is set forth in the notice of opportunity for prior hearing, enclosed.
