SUBJECT:
REGULATORY GUIDE 1.100, " SEISMIC QUALIFICATION OF ELECTRIC EQUIPMENT FOR NUCLEAR POWER PLANTS" In Meeting No. 36 on September 19, 1975, the Regulatory Requirements Review Committee characterized Regulatory Guide 1.100 as Category 2 -
Further staff consideration required in order to determine the need for backfitting.
Further staff consideration on this issue resulted in the position published in Standard Review Plar (SRP) 3.10 in November 1975, regard-ing the staff requirements for ;mplementation, which was approved by the Director, Office of Nucle r Reactor Regulation. The implementation requirements are:
a.
Applications ur.dar review whose cps were docketed before October 27, 1972, sre to be reviewed against SRP 3.10, Paragraph 11.1.
b.
Applications under review whose cps were docketed after October 27, 1972 are to be reviewed agai.nst SRP 3.10, Paragraph II.2, which in-corporates the provisions of Regulatory Guide 1.100, Revision 0, that subsequently was published in March,1976. Consistent with the recommendations of the Comittee, Revision 0 of the Guide is now being used by the staff in conjunction with SRP 3.10, Paragraph II.2 for applications under review whose cps were docketed after October 27, 1972, but before August 1,1977 (the effective date of Revision 1 of the Guide); and Revision 1 is being used for applications under review whose cps are docketed after August 1,1977.
In Meeting No. 64 on June 14, 1977, the Committee characterized Revision 1 of Regulatory Guide 1.100 as Category 1 - No backfit. This categorization was not and is not intended to change or affect the implementation require-ments of the regulatory position concerning this issue arising from the earlier recomendation of the Comittee, which requirements were documented 781102 0 %

In fact, the major basis for the Comnittee's "no backfit" recommendation for Revison 1 of this guide was the fact that Revision 0 was being applied to plants subject to such backfit.
As a general rule, and unless explicitly stated by the Committee, the characterization of a regulatory position on a safety issue as Category 1 is not intended to repeal or ebrogate implementation of a prior regulatory position concerning that issue that is already in place prior to the effective date of the Committee recommendation.
