TO FEBRUARY 19, 1987 MEMORANDUM AND ORDER  !

NOW COMES the Town of Hampton and responds to this Board's MEMO-RANDUM AND ORDER dated February 19, 1987 as follows: f

1. By Order dated December 23, 1986, this Board established a deadline of January 27, 1987 for the parties to respond to Applicant's Petition to reduce the EPZ.
2. Under date of January 26, 1987, the Town of Hampton submitted to this Board TOWN OF HAMPTON MEMORANDUM IN OPPOSTION TO APPLICANT's PETITION TO REDUCE EPZ.
3. The Town's January 26 Memorandum is intended solely to address the issue whether Applicant has established a prima facie case for waiver of the Commission's emergency planning requirements under 2.758.

4. From this Board's February 19, 1987 Order, the Town of Hampton understands that this Board will permit " additional time up to twelve months" for parties to submit " final, complete t.echnical responses to Applicant's 10 CFR S2.758 petition." 5. In the event this Board determines, notwithstanding .

Intervenors' objections, that Applicant has established a prima facie case for waiver under 2.758, the Town intends to file a " final, complete technical" response to Applicant's petition within twelve months thereafter.
