RESPONSE TO ISSUES RAISED IN OCTOBER,1998, U.S.-
EURATOM MEETING I am writing in response to your note of November 17,1998, that forwarded a route slip from Mr. John Dooley, U.S. State Department, dated November 5,1998. By that route slip, Mr.
Dooley transmitted the classified minutes from an October 19-20,1998, U.S.-Euratom meeting.
The minutes raised several issues, among them an unclassified question on the NRC's evaluation of the Louisiana Energy Services (LES) application for the Claiborne Enrichment Center.
The LES' application to construct and operate an enrichment plant was evaluated by NRC in the same way as other license applications to NRC. The fact that the consortium seeking the LES license included foreign companies had no bearing on the NRC's review of the license.
The difficulties in licensing the LES facility instead were due to interpretation of what is needed to meet requirements associated with the National Environmental Policy Act (specifically environmental justice) and financial qualification for licensing an enrichment facility. As a result of the difficulties encountered, NRC has committed to develop and implement a more predictable and less time consuming licensing process for future enrichment facility licensing applications.
