APPENDIX A NOTICE OF VIOLATION Public Service Company of Colorado Docket:
50-267/86-07 Fort St. Vrain License:
DPR-34 During an NRC inspection conducted on March 17-20, 1986, a violation of NRC requirements was identified.
The violation involved the failure to report unplanned radioactive effluent releases in the Semiannual Radioactive Effluent Release Report.
In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violation is listed below:
Failure to Report Unplanned Liquid Radioactive Effluent Releases Facility Operatirig License Technical Specification 7.5.1.e requires, in part, that "Routin.i Radioactive Effluent Release Reports covering the operation of the unit during the previous 6 months... shall be submitted within 60 days af ter January 1 and July 1 of each year.
The Radioactive Effluent Release Reports shall include a list and description of unplanned releases from the site to unrestricted areas of radioactive materials in gaseous and liquid effluents made during the reporting period."
Contrary to the above, the NRC inspector determined on March 18, 1986, that the Semiannual Radioactive Effluent Release Report for the period January-June, 1985, did not include information concerning an unplanned radioactive liquid effluent release that occurred on March 17, 1985.
This is a Severity Level V violation (Supplement I) (267/8607-01).
Pursuant to the provisions of 10 CFR 2.201, Public Service Company of Colorado is hereby required to submit to this office, within 30 days cf the date of the letter transmitting this Notice, a written statement or explanation in reply, including for each violation:
(1) the reason for the violations if admitted, (2) corrective steps which have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
Where good cause is shown, consideration will be given to extending the response time.
