REQUEST OF SENATOR ALFONSE M. D'AMATO TO PRESENT ORAL STATEMENT AT PREHEARING CONFERENCE 4 .

Pursuant to Section 2.715(a) of the Commission's regulations, the undersigned, Senator Alfonse M. D'Amato of New York, hereby requests permission to appear at the prehearing t conference to be rescheduled from September 3, 1986, to a future date in order to make an oral statement. Section 2.7.15(a) specifically authorizes such an appearance as follows:

I am elected to represent the interests of the citizens of the State of New York and, here, particularly, -I represent ~ the ~'s '

interests of the citizens of Long Island. The instant request is' to inform the Atomic Safety and Licensing Board of immediate procedural and substantive concerns raised by the February 13 -

exercise of LILCO's emergency plan. Such presentation will be brief.

It is especially appropriate for the Board to grant this rcquest. In official correspondence with both FEMA and the NRC, I repeatedly sought to have FEMA conduct a meeting with the public residing near Shoreham, just as FEMA does after emergency preparedness exercises at other nuclear power plants. Both e agencies refused. Nevertheless, both emphasized that the issues raised by the February 13 exercise would be fully aired in the present adjudication. I want to assure that the adjudication concerning the February 13 exercise is full and fair in all respects to the millions of New Yorkers whose safety would be affected by the Shoreham plant. My interest is in the safety of my constituents. Therefore, I have a direct interest in this proceeding and will contribute positively to the discussion of ,

matters relevant to the prehearing conference. The Board's grant of this request accordingly is a proper exercise of discretion under Section 2.715(a).
