2 PR0CEEDINGS 3 CHAIRMAN PALLADINO: I think it is important that we 4 address the issue before us. The purpose of this meeting is to 5 vote on a proposed Order regarding the Perry Nuclear Power 6 Plant and I'll ask the Secretary to lead us through the item.

7 MR. CHILK: Mr. Chairman, before we vote on the 8 Order, I need to ask the Commission to vote on holding this 9 meeting on less than one-week's notice. Will all in favor say 10 "aye."

11 (Chorus of " ayes.")

12 MR. CHILK: Opposed.

13 (No response.)

jr MR. CHILK: The paper that we are dealing with comes 15 up in SECY-86-109 and 86-109A, as amended by a Memorandum and 16 Order which was distributed this afternoon.

The Commission here is being asked to address a 17 jg decision of the Atomic Safety and Licensing Appeal Board to hold an exploratory hearing to aid in its determination of 39 whether or not to reopen the Perry hearing on the issues 20 relating to the facility's seismic design.

21 In previous issues of the Order, the Chairman, 22 Commissioners Roberts, Bernthal and Zech had approved the Order 23 and this Order is the same which vacates the Appeal Board's 24 Order setting up an exploratory' hearing and denies the Motion 5

to Reopen and directs the staff to be prepared to discuss the m
