Dear Mr. Suppos:

This is to confirm the receipt of the Ohio draft request for an Agreement with the Commission under Section 274b of the Atomic Energy Act of 1954, as amended, submitted by your letter osted January 23,1998. The draft was evaluated by my staff for completeness of the information supporting the request against the Commission Policy Statement entitled " Criteria for Guidance of States and NRC in Discontinuance of NRC Regulatory Authority and 4

- Assumption Thed,of by States Through Agreement"(46 FR 7540; January 23,1981), as amended by statements published on July 16,1981 (46 FR 36969), and on July 21,1983 1 (48 FR 33376) - Based on that review, we noted a noud for additional information describing the

- low-level waste, the sealed source and device safety evaluation, end the uranium mill tailings l

program elements.

1 These information needs were discussed by Mr. Richard Blanton of my staff and Ms. Marcia Howard during a telephone conversation on February 11,1998. The_information addressing these areas was provided on February 25,1998.

'We are starting a detailed technical review of the draft request. We will provide, under separate cover, a proposed schedule for actions needed to complete the processing of the Agreement. In . "

this schedule, we seek to respond to your desire to conclude the Agreement by December 31, 1998, We must note, however, that this schedule leaves little time beyond the minimum required to complete the activities required by the Act and Commission policy, and all n,ajor milestones mot be completed by the scheduled datei At this time, we believe that the proposed schedule can theoretically be met, but only provided that no significant issues arise from the i detailed technical review of the proposed Ohio program, and that no extemal events occur that demand priority attention of the staff, the Commission or the State. We will closely monitor progress aga!nst the schedule and inform you of any changes.

As discussed with Ms. Howard, we propose to schedule regular telephone conference calls for the exchange of lnformation and to track the processing of the Agreement. The calls should

. Irmiude the primary and backup contacts for the State, NRC Headquarters, and NRC Region ill, plus such management representatives as may be appropriate for the matters to be discussed.

We suggest that these calls be fixed for day of the week and time, and that they be held at Intervals of two y/seks to start, increasing to weekly as the process approaches conclusion. \.

Director g Office of State Programs U.S. Nuclear Regulatory Commission Washington, D. C. 20555-0001 Dear Mr. Bangart I am writing in response to Paul Lohaus' letter of December 19,1997. Mr. Lohaus wanted to know our schedule for submitting a complete draft of Ohio's application for Agreement State Status. At the time we received his letter, Ohio was very close to submitting our draft. In consultation with Dennis Sollenberger and Mr. Lohaus, Ms. Marcia Howard of my staff provided some portions of the draft application to Mr. Lohaus for his initial review. Based on that review and discussion, the Bureau of Radiation Protection is pleased to submit this iratial draft of our application. It is our firm desire to have our agreement signed and in effect no later than December 31,1998, The Bureau of Radiation Protection is very willing to do anything necessary to enable Ohio to achieve our desire.

We look forward to working with NRC as you begin the review of Ohio's draft application. I am designating Ms. Marcia Howard as Ohio's primary contact regarding the aoplication. As questions arise, please contact Ms. Howard or myself at 614-644-2727.
