SUBJECT:

PROPRIETARY MAT EIAl. CONTAINED IN A MEETING

SUMMARY

Daar Mr. McIntyre:

On October 14, 1997, you brought to the staff's attention that a meeting summary dated September 30, 1997, titled " Summary of AP600 Meeting to Review the Structural Design of Nuclear Island Structures", contained proprietary material.

Specifically, Attachment 10 to this document contained one page of material marked proprietary. The material was submitted without the required 10 CFR 2.790 and the cover letter for the summary does not indicate that it contains proprietary information. Therefore, the material was not treated as containing proprietary information, and it received the nermal distribution for a non-proprietary document.

The purpose of this letter is to document the corrective actions that the staff is taking to correct this problem. The corrective actions are as follows:

1)

The staff has already taken stops to remove the proprietary page from the public document room, and it will be treated as proprietary material.

2)

On October 17, 1997, you requested that four individuals who were on the AP600 distribution list, and who received this material, be requested to return the entire meeting summary package to the staff. As such the staff sent ietters to those four individuals.

Copies of the four letters are enclosed for your information.

I will contact you as soon as all four copies have been returned.

3)

As discussed with you, the staff will not ask the Westinghouse employ-l ees, Department of Energy employees, Mr. Russ Bell, Barton Z. Cowan, and Mr. Ed Rodwell to return their respective meeting summaries.

Mr. Brian A. McIntyre October 22, 1997 In addition to the corrective actions stated above, the staff requests that Westinghouse submit a letter stating that the affidavit dated July 28, 1997, for WCAP-14407, Revision 1 "WGOTHIC APPLICATION TO AP600" applies to the proprietary page that was used in the meeting summary, and-that Westinghouse still considers the information to be proprietary.

If you have any questions regarding this matter please contact me at (301) 415-1132.
