Dear Mr. Salas:
I arn respondi.g to your November 10,1997, faxed letter regarding invoice No. AM5374 97 for License No. 56-29020-01. Your letter states that: (1) the gas chromatograph is no longer in use; (2) licensed activities were ceased on 1994;(3) the process of transferring the device and terminating the license started in June 1996; (4) you were under the assumption that the FY 1997 annual fee was not applicable because you were in the process of toiminating the license, and; (5) you are requesting the waiver o' the FY 1997 and FY 1998 annual fees. For the reasons stated below, we are denying your request for FY 1997 and granting your request for FY 1998.
Our records show that License 56-29020-01 was terminated November 4,1997, in accordance with your request dated Octnber 15,1997. Footnote i of 10 CFR 171.M provides that the annual fee is waived when a license is temunated prior to October 1 of each fiscal year. The FY 1997 annual fee is walved for those licensees and holders of ceriificates, registrations, and approvils who either filed for termination of their licenses or approvals or filed for possession only/ storage only licenses prior to October 1,1996, and permanently ceased licensed activities by September 30,1996. An amendment request filed after October 1 of each fiscal year to cance, a license does not cancel the annuel fce invcice. Your October 15,1997, termination request was not timely filed for purposes of avoiding the FY 1997 or FY 1998 annual fee. And, we find no evidence in the files to indica e you were in the prucess of termin0 ting your license prior to your letted dated August 5,1997, ir# which you indicated you were retuming the device to the manufacturer and were going to terminate your license. Therefore, invoice AM5374 97 is due a.id payable. Late charges will be waived if payment is received within 30 days from trie date of this letter.
However, based on the information in the files, the NRC grants an extension of time for purposes of avoiding the FY t998 annual fee to Oc+ober '5.1997.he date you requested termination if you have ar,y further questions, please contact Fata Mew:ar on 301-415-6067.
