SAFETY EVALUATION BY THE OFFICE OF NUCLEAR MATERIALS SAFETY AND SAFEGUARDS RELATED T_O AMENDMENT NO. 7 TO MATERIALS Lt. CENSE NO. SNM-1993 KERR McGEE CORPORATION CUSHING REFINERY SITE DOCKET NO. 70-3073

1.0 INTRODUCTION

The Kerr-McGee Corporation, the licensee, by letter dated September 2,1997, submitted an application requesting that its Cut,hing refinery site (Cushing site located in Cushing, Oklahoma) license be amended to approve the design and construction of a proposed Radioactive Material Storage Area (RMSA).

2.0 BACKGROUND

On April 6,1993, the U.S. Nuclear Regulatory Commission bsued Materials License SNM-1999 to the Kerr McGee corporation for its Cushing site. This license authorized the licensee to possess contaminated soil, sludge, sediment, trash, building rubble, and any otNr contaminated material, at its Cushing site. In A.aandment No. 7 the staff is approving the design and construction of the licensee's proposed RMSA.

3.0 EVALUATION License Condition 11.B.1 requimd the licensee to provide an analysis of the ability of the oroposed three temporary radioactive waste storage areas to effectively resist erosion by wind and water. Also, the licensee was required to describe the measurement procedures to be used to control the sorting of the contaminated materials to be transferred to the temporary storage areas. This information was to be provided prior to transferring contaminated material to any of the three prooosed radioactive waste storage areas.

Site Decommissioning Plan (DPlan) Section 3.4.10, 'On-site Storage." In this revised section of i the DPlan the licensee provided design information related to its proposed RMSA. The licensee requested approval of an this section of the DPlan to allow it sufficient time to construct the RMSA .n order to support Wasto Acid Pit 4 remediaHon.

Since the licensee originally submitted the DPlan, its plans for interim radwaste storage have changed. The licensee has decided to construct a single temporary radioactive waste storage alea rather than three separate storage areas. Also, the licensee plans no longer include on- l site disposal. The licensee now plans to ship for off-site disposal material found to be greater than NRC's Branch Technical Position (46 Federal Reaister 52061) Dispos # etion 1. be transferred to the temporary storage areas is no longer necessary. The staff agrees based 1 on the licens6e's current proposal to ship for off-site disposal greater than Option 1 material. I The licensee proposes to construct the RMSA over the existing site Radioactive Material Area -

(RMA) 12. The RMSA will be used to accumulate, temporarily store, and package for shipment -

- greater than Option 1 material. The licensee's proposed design of the RMSA is an earthen berm ranging from a minimum of 1.5 feet high on the uphill side to 20 feet high on the downhill side. For erosion control the berms will be constmeted with a fine grained cohesive material with a slope not to exceed 3:1 and will be covered with vegetation. A fence will be constructed ~ ,

  • in accordance with 10 Code of Federal Regulations (CFR) Part 20. The RMSA will be sized to -
accommodate two times the total of the 25 year flood, a 24-hour rainfall event (approximateiy-seven inches of rain), and 6,000 cubic yards of material. The staff has reviewed the proposed ,

RMSA design and finds it acceptable for the purposes of accumulating, temporarily storing, and r packaging for shipment greater than Option 1 material.

The staff has revit.ved the licensee's RMSA air monitoring and RMSA effluent discharge proposals. The staff finds them acceptable with one exception, demonstration that the liquid i effluents monitoring program will ensure compliance with the requirements of 10 CFR Part 20, Appendix B.

Based on the above the staff will authorize the conatruction of the RMSA but will revise License Condition 11.B.1 to prohibit the licensee from placing contaminated material into the RMSA until

the staff has approved the licensee's RMSA liquid effluent monito - J program.

4.0 STATE CONSULTATION

4 The Ok!ahoma State official was notified of the proposed issuance of Amendment No. 7. The State official had no comments.

5.0 CONCLUSION

NRC has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operution in the proposed manner; (2) such activities will be conducted in compliance with NRC

' regulations; and (3) the issuance of Amendment No. 7 will not be inimical to the common

, defense and security or to public health and safety.
