Washington, D.C. 20555 bl (E-mail: SECY@NRC. gov) i To the Office of the Secretary, This letter serves to amend, clarify and restate, if necessary, my concems about the transfer application for the Three Mile Island Nuclear Station Unit 1.

My original January 11,1999 letter was mailed to all parties on that day and faxed to the NRC. Again, I don't know when the U.S. Postal Service postmarked these letters but they were delivered to the U.S. Postal Service facility on Elmerton Avenue and Crooked Hill Road on January 11,1999.

My original January 11,1999 letter was intended to be a request under section 2.1306 for a hearing. I did present my name, address and telephone number. I am a ratepayer of GPU/Penelee and I work and live near TMI during the legislative session as a constitutionally elected state representative who is the Democratic Chairman of the Environmental Resources & Energy Committee My letter did raise the issue of safety and health concerns about the transfer of the facility.

My specific concerns are as follows:

1) Will AmerGen possess the requisite technical and financial qualifications to own and operate TMI-l?
2) Does the proposed transfer raise any significant safety issues?
3) Will AmerGen be owned, controlled or dominated by an alien, foreign corporation or foreign government?

These concems are within the scope of the proceedings on the license transfer application and are relevant to the findings that the NRC must make to grant the application.

Some of these concems are based on materials placed in the record that relate to the details of the financial commitment and the financial controls that AmerGen has structured into its partnership agreement. Additional concerns are raised by potential

. changes in the levels of staffing that may occur through voluntary retirement programs or by other near term staffing changes. Concems about foreign control are raised by terms -

of the partnership agreement, one of which allows British Energy to shut down TMI -

without the consent of PECO. Moreover, issues of Y2K and emergency and evacuation coordination appear not to be satisfactorily addressed. As a result, there is a genuine dispute issue on material issues of fact, if not law on this application.

Having the NRC hold a hearing on this matter and inviting the public and interested parties to present testimony and questions seems to be the most appropriate action on the part of the Commission.

Pennsylvania, the Three Mile Island Nuclear Station was the site of a nuclear accident. I request that your agency pursue this matter to ensure that Pennsylvanians are not put at risk by this facility again.
