OF LICENSE RENEWAL STEERING COMMITTEE ME5 TING WITH THE NEl LICENSE RENEWAL WORKING GROUP The Nuclear Regulatory Commission's (NRC's) License Renewal Steering Committee (LRSC) met with the NEl License Renewal Working Group on January 14,1999, to discuss the status of l

license renewal activities and the resolution of generic license renewal issues. Attendees are l

listed in Attachment 1. The agenda for the meeting is contained in Attachment 2. Presentation materials used by Baltimore Gas and Electric (BGE) and Duke Energy Corporation (Duke) are l

contained in Attachments 3 and 4, respectively. Following is a summary of the topics discussed at the meeting:

Apolication Review Status Q;lvert Cliffs BGE stated that overallit is pleased with the progress made to date. However, BGE is anxious about to what depth the staff will go in reviewing existing programs and current licensing basis practices. BGE does not believe that the staff needs to re-review existing programs such as the environmental qualification program. BGE stated that it could provide descriptions of the implementation of existing programs and make presentations to the staff to help the staff better understand the adequacy of its existing programs.

BGE also requested that the staff evaluate whether the schedule for issuance of the renewed license could be improved, specifically the time between the issuance of the safety evaluation report (SER) with open items and the draft environmental statement (DES) to the final issuance of the documents. The staff responded that it was continually looking for opportunities to improve the schedule. and that improvements in schedule can best be assessed after the SER and DES are issued and the number and type of open items are known.

Oconee The review of the Oconee renewal application is on schedule. The staff issued all technical i

requests for additionalinformation (RAls) by December 4,1998, and environmental RAls by

December 29,1998. Duke is currently preparing responses. A series of conference calls have V, f-7 been held to obtain staff clarification of RAls, where needed, to support Duke's submittal of responses to the technical RAls by February 17,1999, and environmental RAls by March 4, 1999. Duke indicated that this process has been working well and that it will continue to be used g

in the future to address topics as needed. Duke is also interested in discussing improvements in the schedule, if possible.

License Renewal Inspection Prooram S**s i

- At the time of the meeting, the plan for the Calvert Cliffs scoping inspection was currently being l

finalized by the staN. The plan was subsequently approved and provided to BGE to prepare for i

F the inspection and to NEl and Duke for information. The staff intends to meet with BGE before j

the actual inspection occurs. The inspection is scheduled to begin the week of February 8, 1999.

~ The staff is also preparing the scoping inspection plan for Oconee. Duke was requested to j

expedite the responses to the stars RAls in the scoping area as the staff must complete the

SER sections for scoping in order to finalize the inspection plan. The staff is planning on the j

Oconee inspection occurring in late March or early April 1999.

' Resolution of Priority 1 Generic Renewal issues (GRis) i provides the list of Priority 1 GRis. The staff has had difficulty supporting i

schedules established for completing the GRis without impacting the review of the Calvert Cliffs and Oconee applications. Plant-specific resolution of the issues are being pursued for the 2 l

l applications to support their schedules in parallel with developing the generic positions needed j

i for incorporation into implementation guidance. In some cases, resources needed to address l

the GRls are the same as those needed to support the application reviews, in response to the industry's request, the staff will look at establishing reasonable target dates for issuing positions i

on the GRis. This topic will be discussed at the next meeting.

The industry questioned what criteria was being used by the staff to declare a renewal issue as generic and to send the issue to NEl to be addressed. The staff agreed to discuss at the next j

meeting the criteria and process by which the issues are identified and sent to the industry.

Environmental Qualification (EQ) Time-Limited Aoina Analyses (TLAAs) j r

The EQ issue has been discussed extensively in past NRC management meetings with BGE l

' and Duke and in meetings between the LRSC and NEl Working Group, The industry continues j

i to question the staffs need for a renewal applicant to demonstrate the adequacy of existing l

i

aging management programs such as EQ where well-established and well-regulated programs are relied upon to manage the effects of aging. The NRC staff reiterated that 10 CFR Part 54 j

requires that the staff make an explicit finding that the applicant has provided the demonstration

)

j required by $54.21 for all aging management programs. The staff stated again that its position is not that the existing program established to comply with 10 CFR 50.49 is unacceptable, but that 1

a description of the applicant's pcocess (not all of the program details) for maintaining the i.

'qualificabon of electrical equipment is needed in order to provide the demonstration required by i

Part 54.

The staff and industry are trying to establish a generic position on the scope and level of detail l

required for the demonstration of EQ programs in parallel with continuing the review of the Calvert Cliffs and Oconee applications. The generic position will be used to incorporate ii J

3 guidance into the License Renewal Standard Review Plan and Regulatory Guide for future applicants. The staff has issued RAls to BGE and Duke in this area and a number of meetings and telephone calls have occurred to clarify the requests. The review of the Calvert Cliffs and l

Oconee EQ programs are proceeding to support the schedule for issuing the renewed licenses.

NEl stated that continued compliance with the requirements of 10 CFR 50.49 should be sufficient without further justification for meeting the demonstration requirements of $54.21(c)(1)(iii) for EQ TLAAs. NEl and industry representatives indicated that they plan to express their concem on this issue in future meetings with the Commission 6.

Future Actions The Commission has asked the staff in the past how many renewal applications are expected and when they would be submitted. The concem is that a large number of applications received at the same time could exceed available staff resources. The staff and industry continued discussing whether NEl working with industry could develop a process to identify and meter the applications submitted to the NRC. In this way, the staff could maintain a constant resource level.

The next meeting between the LRSC and the NEl Working Group was subsequently scheduled for March 30,1999. Topics to be discussed include (1) potential for schedule improvements for BGE and Duke, (2) target dates for the GRis, (3) discussion of the criteria for identifying generic issues for industry resolution, (4) resolution of the EQ issue, and (5) ability of industry to identify the number and timing of future applications and industry's ability to meter the applications.
