PROPOSED IMPOSITION OF CIVIL PENALTIES - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $75,000 will be issued on or about July 29, 1986 to Detroit Edison Company for their Fermi-2 facility.
This action is based on three violations of NRC requirements which involved the failure to maintain a valve open as required by a special condition of the operating license, two instances of the violation of primary containment integrity, and the removal from service of a room cooler serving emergency core cooling systems. These violations occurred during the period from June to September 1985.
It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorized by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:
Mailing of Notice July 29, 1986 Telephone Notification of Licensee July 29, 1986 A news release has been prepared and will be issued after the licensee receives the Notice.
The State of Michigan will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
