The NRC does not have Federalland management responsibilities and, therefore, does not t

directly engage in maintaining or restoring archeological or historic properties that may be identified during the environmental review process for issuing permits or licenses. However, NRC licensees are required to take the mitigative measures necessary to protect such properties. As a regulatory agency, NRC does not incur any direct costs associated with the protection or enhancement of archeological and historic resources.

l Narrative Responses to the Secretary of Interior's 1998 Report to Congress Further Clarification for D1:

Calvert Cliffs Nuclear Power Plant - Cultural resources site and map files and literature searches were completed for the 2300-acre Calvert Cliffs Nuclear Power Plant site, located in Calvert County, Maryland. The searches revealed the presence of three recorded historic properties. No known archaeological sites were identified. The results of this effort will be reported in the U.S. Nuclear Regulatory Commission's (NRC's) environmental impact statement to be issued in response to the license renewal application submitted by Baltimore Gas and Electric Company. This statement is scheduled to be issued for public comment in June 1999.

Further Clarification for D5:

Haddam Neck Nuclear Power Plant - The Advisory Council on Historic Preservation contacted j

the NRC regarding the effects of decommissioning of Haddam Neck Nuclear Power Plan, located in Meriden, Connecticut, on properties eligible for listing on the National Register of Historic Places (NRHP). The foundation of a former slave's home, known as the Venture Smith Homesite, is located in a publicly accessible area of property located on the site of the Haddam Neck Plant, licensed to the Connecticut Yankee Atomic Power Company. Connecticut Yankee officials stated that the site would not be disturbed during dismantlement of the plant. Two local citizens agreed to continue to keep the area cleaned up as they have done in the past. This information was provided by the NRC to the Advisory Council to help determine the eligibility of the Venture Smith Homesite for the NRHP.

Further Clarification for D6:

Diablo Canyon Nuclear Power Plant - Pacific Gas and Electric, the licensee for Diablo Canyon Nuclear Power Plant, which is located in San Luis Obispo, Califomia, maintains a program to protect two archeological sites (CA-SLO-1 and CA-SLO-2) on their property. In 1998, the licensee evaluated several activities associated with access to and maintenance of electrical transmission equipment near the CA-SLO-2 site. Repairs were also made to stairs that pass i

through the CA-SLO-2 site on the route to Diablo Cove, in each case, it was determined that i

the activity did not adversely impact the archeological site. An evaluation was performed to determine if chemicais used at a fire training facility near the CA-SLO-2 could adversely affect the data within the archeological deposit. The results of literature searches and consultations with experts was inconclusive. The licensee continues to monitor the site and notes no new areas of erosion or other impacts.

l Response to D.7:

Babcock & Wilcox (B&W) Shallow Land Disposal Area (SLDA) The NRC prepared a Draft Environmental Impact Statement (DEIS) for the decommissioning of the B&W SLDA, located in Parks Township, Pennsylvania. The SLDA is an area which was used in the 1960s and 1970s to dispose of radioactively-contaminated materials (primarily uranium and thorium) and non-radioactive waste in accordance with 10 CFR Part 20.304. (The NRC rescinded this regulation in 19tH.) At least some of the waste in the SLDA is known to exceed NRC's existing i

radiological criteria for decommissioning. As p6rt of the development of the DEIS for this site, 1

NRC consulted with the Pennsylvania Office of Historic Preservation. During 1997, it was

determined that no American Indian groups, lands, or burial grounds were identified in the vicinity of the project site. (Previous disturbance of the SLDA area would likely have eliminated archeological or historical artifacts.) The DEls was published for public comment in the Federal Register on September 4,1998. Subsequently, NRC withdrew the DEIS for reasons unrelated to archeological / historic activities, and the staff is developing additional decommissioning information. A revised DEIS will be published for comment and a public meeting scheduled.

Hydro Resources. Inc. (HRI) In-Situ Leach Uranium Project - During 1997, the NRC staff reviewed HRl's " Cultural Resources inventory of Proposed Uranium Solution Extraction and Monitoring Facilities at the Church Rock Site and of Proposed Surface irrigation Facilities North of the Crownpoint Site, McKinley County, New Mexico" (MNM Report), prepared by the Office of Archeological Studies, Museum of New Mexico on behalf of HRI. The report was also forwarded to the New Mexico State Historic Preservation Officer (NMSHPO), the Navajo Nation Historic Preservation Department (NNHPD), Bureau of Land Management (BLM), Bureau of Indian Affairs, and several local Indian tribal authorities / councils ir. the Crownpoint area for their review and comment. For the first five-year phase of the project, the MNM Report identified 21 archeological sites on private land, and 12 archeological sites on BLM land that were eligible under Criterion D for listing in the National Register of Historic Places (NRHP). The eligibility for listing in the NRHP of one additional archeological site on private land and five additional l

archeological sites on BLM land was undetermined.

During FY 1998, the NRC continued the National Historic Preservation Act (NHPA) Section 106 process for the Crownpoint project. Based on its review of the MNM Report and consultation with the aforementioned organizations and agencies, the NRC staff made the determination that the project would have "no effect" on the eligible and undermined archeological sites within j

the project boundaries. The NMSHPO and NNHPD concurred with the NRC staff determination, and other organizations and agencies provided no comments. Thus, the staff completed its Section 106 consultations in accordance with NHPA for this phase of the project and notified HRI of its findings. The NRC staff is presently reviewing and commenting on the next proposed development area of the Crownpoint project, and will continue Section 106 j

consultations with all concemed parties.

Intemational Uranium (USA) Corooration (IUSA) In-Situ Leach Uranium Minina Proiect - During FY 1994 and 1995, the NRC staff reviewed IUSA's " Class ill Cultural Resources inventory of Energy Fuels Nuclear, Inc., Reno Creek Project Campbell County, Wyoming", prepared by Frontier Archeology of Worland, Wyoming on behalf of Energy Fuels Nuclear, Inc. (EFN). EFN was the former owner of the Reno Creek property. The information was forwarded to the Wyoming State Historic Preservation Officer (WYSHPO) for review and comment. The WYSHPO's response indicated that the project will have no effect on historic properties in the area covered by the cultural resources survey. The WYSHPO further indicated that no ground-disturbing actions would be permitted outside the areas surveyed until the WYSHPO has been provided an opportunity to review the required documentation on the additional acreage to be disturbed.

During FY 1998, the NRC continued the National Historic Preservation Act (NHPA) Section 106 process for the Reno Creek project. Given the length of time that had elapsed since the last evaluation, NRC staff re-initiated the review process, revisited the Reno Creek project site, and consulted with the WYSHPO who recommended that Native Amer:::an groups having a l

potential interest in the project be consulted. This reccmmendation was followed by a letter of i

September 15,1998, with the Bureau of Land Management Buffalo, Wyoming, Resource l

Area's soliciting comments and concems from six Native American groups.
