4 MOTION FOR

SUMMARY

DISPOSITION OF CONTENTION SAPL SUIP. 6 (FORMERLY NH-10)

Now come the applicants pursuant to 10 CFR $ 2.749 and i

on the basis of the Affidavit of Edward A.

Sawyer (Sawyer Affidavit) attached hereto and marked "A," move that the Board grant a summary dispositior Cf Contention SAPL Supp.

6.

(formerly NH-10) in f avor of ar g li ' nts, and as grounds therefore say the following:

By an order issued September 13, 1982, the Licensing Board admitted into litigation the following contention as Contention NH-10.

i "The Seabrook Station control room design does not comply with general design criteria 19 through 22 [of] 10 8607310167 860725 PDR ADOCK 05000443 G

PDR

C.F.R. Part 50, Appendix A and' NUREG-0737, item I.D.1 and I.D.2."

ASLB Order of Sect. 13, 1982 at 21.

The statement of basis upon which the Board allowed admission of this contention was as follows:

"The basis of this contention is to assure that displays and controls added to the control room after DCRDR do not increase the potential for operator error."

Id.

NH-10 has been, with the permission of'this Board withdrawn by its original sponsor.

ASLB Order of July 21, 1986.

By that same order NH-10 was " converted to and replaced by SAPL Supplemental Contention 6 which will reflect the identical wording and basis of former Contention NH-10."

Id. at 7 (emphasis added).

As set forth in the Sawyer Affidavit, the DCRDR review, including the review of human factors perspective of displays, including SPDS displays, has been undertaken and the displays and controls added, or to be added, to the control room as a result of the DORDR do not increase the potential for operator error.

Thus, the contention, as admitted, has been fully satisfied and there remains no factual matter to be litigated.
