Dear Dr. Niemczyk:

In recent letters you mentioned that you wish to obtain copies of recent USNRC sponsored source term reports and that you have had difficulty in obtaining timely information about NRC's source term research meetings.

With respect to USNRC sponsored source term reports, I am making arrange-ments for the affected divisions in the Office of Nuclea'r' Regulatory Research to send you copies of recent USNRC sponsored reports that have been received from our contractors and future copies after they have been received from our contractors.

Please be aware that you will be receiving reports from contractors which have not been critically reviewed and/or accepted by the USNRC. Accordingly, the NRC does not warrant or approve these reports, but merely makes them available to you on a " peer review" basis. Additionally, many of these reports were developed in the course of joint ventures with private industry and foreign partners under agreement that these reports not be made public. Accordingly, we ask that you not release or disclose the content of these reports to third parties.

With respect to your difficulties in getting timely information about the NRC's source term research meetings, I have made arrangements for each affected division in RES to provide advance notice of all open meetings on l

source term research by posting such announcements in the USNRC Public Document Room at 1717 H Street, NW.

I have also made arrangements with Mr. Mel Silberberg to send to your 18th Street address all of these announcements. We understand that the Office of Nuclear Reactor Regulation (NRR) has made similar arrangements to send you their announcements of open scheduled meetings on source term.

I also wish to take this opportunity to notify you that the NRC has evaluated the results of the semi-annual partners SFD/ST meeting in Bethesda last October and concluded that opening the meeting to non-partners severely restricted the conduct of program business by meeting attendees and signifi-cantly limited the value of the meeting.

There was a significant decrease in the participatory discussion by foreign partners, which has been the cornerstone of these meetings in the past. The flow of information from these foreign-country partners during discussions of the presentations was, therefore, greatly reduced.

In such a situation it is the U.S. public that suffers, because the NRC is deprived of much important information that is in the hands of foreign or private partners but which will not be passed to us in an open forum.
