Dear Administrative Judges Moore and Kelber:
The NRC Staff is filing today, as an enclosure to this letter, its response to Mr. Philippon's written presentation. The Staff notes that the affidavit of Mr. Hironori Peterson, which is an integral part of the Staffs response, attaches eleven exhibits (in addition to his statement of professional qualifications) which have not been submitted previously as part of the hearing file. Several of the exhibits simply provide additional backgrpund, while other exhibits have been included because they have been referenced by Mr. Philippon in his written presentation and the Staff's response, therefore, addresses them. Consistent with 10 C.F.R.
$ 2.1231(c), the submission of these exhibits with the Staff's response is being rres:e in a manner consistent with the way the hearing file was initially provided under 10 C.F.R.
