Dear Mr. Lochbaum:
I am responding to your January 29,1998, e mail requesting information on the annual fees for decommissioning power reactors and independent spent fuel storage facilities.
You specifically asked what the annual fees are for a permanently closed nuclear power plant (i.e., Part 50 license) and for an independent spent fuel storage facility (i.e., Part 72 license).
The FY 1997 annual fee for an independent Spent Fuel Storage Installatioa (ISFSI) is
$283,000. Nuclear power plants and other licensees in a permanently shutdown configuration are not charged an annual fee. We are currently developing tha FY 1998 fees.
You indicated that you had been told that the reason one utility, which is pursuin0 decommissioning its power reactor, wanted to store spent fuel under 10 CFR Part 50 instead of 10 CFR Part 72 was that it would save approximately $240,000 per year in license fees. The Commission is aware of this concern and is cone.idering what NRC action may be appropriate to address it.

While the annual fee may be a factor i a licensee's decision on whether to store spent fuel under Part 50 or Part 72, it is not the o cost consideration. For example, the annual operating cost of storage under Part 50 Part 72 as well as construction costs for Part 72 storage would also need to be considere The annual fee for a Part 72 license is not the predominate economic d9terminant for lice ees in making a decision on Part 50 or Part 72 spent fuel storage.
