STATE OF UTAH'S COMMENT ON REVISIONS TO CONTENTIONS AND PROPOSED CORRECTIONS TO THE PRE HEARING TRANSCRIPT In a Memorandum and Order dated February 9,1998, the Board prepared a listing of the agreed upon revisions to the language of various petitioners' contentions and requested comments on these revisions by February 17,1998. In the same Order j

the Board advised that proposed corrections to the transcript for the January 27-29 prehearing conference must be submitted by February 17.

A.

Revisions to State of Utah's Contentions The listing of the State of Utah's Contentions, incorporating revisions

. agreed to by the State in its Reply to Contentions fued January 16,1998 and at the pre-hearing conference are correct with two exceptions. First, Subpart 5 of Contention T, Inadequate Assessment of Required Permits and other Entitlements, should be deleted.

The State withdrew that portion of Contention T dealing with Part 75 requirements.

Second, Utah Contention V, Inadequate Consideration of Transportation Related Radiological Environmental Impacts, subpart 4 should read:

The words 'in that " at the end of subpart 4(a) should be deleted.

By accepting the rewording of contentions, the State does not abandon the bases for its contentions. The contentions must be read as a whole, including their bases.

B.

Proposed Corrections to the Pre Hearing Transcript The Transcript of the Pre Hearing Conference held January 27 29,1998 contains a multitude of mistakes. The State has made a diligent effort to correct substantive mistakes, in trying to discern the meaning of baffling statements, the State sed its best judgment in suggesting changes but there were some instances when it u

was impossible to make any suggestions at all. In such instances the mistakes have not been corrected. On a minor point, 'Rowley Junction" has variously been spelled Rally, Rawley and Rolley. -We have corrected some but not all of all these misspellings. The State's proposed changes to the Tranxtipt are attached as Exhibit 1.

The State motions that these changes be made to the record.
