RESPONSE TO NRC INSPECTION REPORT NO. 99900732/97-01

Dear Mr. Heid:

Thank you fcc your January 8,1998, letter responding to the Notice of Nonconformance (NON) that was attached to the st.bject inspection report. We have reviSwed the Gould's Pumps, incorporated (Gould's) letter and find that your steps taken to correct the concems, steps to prevent recurrence and schedule for corrective and preventive action is responsive to the NON except for customer notification, and Gould's response and justification for the stated Nonconformance.

Since Gould's practice (a departure from the procurement document requirements) of not verifying certain chemical elements had existed for approximately 10 years, Gould's is required to inform all applicable customers where records exist to show that purchasers bought sucpect basic components even if that time period is longer than the required 10 year minimum record retention period. Section 21.21(b) of Part 21 states that if the deviation or failure to comply is discovered by a supplier of basic components, or services associated with basic components, and the supplier determines that it does not have the capability to perform the evaluation tc determine if a defect exists, then the supplier must inform the purchasers or affected licensees within five working days of this determination so that the purchasers or affected licensees may 2

evaluate the deviation or failure to comply, pu suant to Section 21.21(a).

r Conversely, each applicable customer is required by $21.21, " Notification of failure to comply or existence of a defect and its evaluation," of Part 21, to evaluate the circumstances regarding the j

identified concem for their own specific anplications.

Additionally, although we do not agree with Gould's response and justification for the NON, we believe that Gc ald's action to have a third erty entity evalua;a its dedication program is a positive step to correct the concem and to prevent recurrence. We have no further qcsstions at this time, but we do request that Gould's keep the NRC apprised of the third party evaluation n sula, and any findings or recommendations so that we may determine whether further NRC iroiWons are required to resolve this matter.
