SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION SUPPORTING ORDER TERMINATING PROVISIONAL CONSTRUCTION PERMIT NO. CPRR-91 DOCKET NO. 50-241 By letter dated February 6, 1978, as supplemented March 10, 1978, Mississippi State University (MSU) requested authorization to dispose of contaminated reactor components and termination of Provisional Construction Permit No. CPRR-91. By Order dated March 23, 1979, NRC authorized disposal of reactor components by shipment to an authorized burial ground. The reactor components had not been assembled at Mississippi State University nor was fuel acquired.
An inspection by the NRC Region II inspectors confirms that all reactor components held by MSU under Provisional Construction Permit No. CPRR-91 have been removed from the University and has also confirmed that there is no radioactive contamination in excess of normal background levels in the room in which the reactor components were stored. Therefore, since all reactor components have been removed from the University and no residual contamination above normal background remains at the site, Provisional Construction Permit No. CPRR-91 may be terminated.
In accordance with the categorical exclusion of 10 CFR 51.22(c)(9), no environmental assessment is required for the temination of this provisional construction permit.
The staff has concluded, based on the considerations discussed above, that this construction permit termination is in compliance with the Commission's regulations, that there is reasonable assurance that this permit can be terminated without endangering the health and safety of the public and that its termination will not be inimical to the common defense and security or to the health and safety of the public.
