Subiect CONFIRMATORY ORDER MODIFYING LICENSE By EN 98-069, the Commission was informed of the staffs intent to issue an Order Suspending License (immediately Effective) to Special Testing Laboratories, Inc., (STL).
The order was issued December 23,1998. STL's president was also the president of Testwell Craig Laboratories of Connecticut, Inc., a former licensee whose license was suspended for non-payment of fees. This action was based on the findings of NRC inspections and an ongoing investigation, which indicated that STL had deliberately violated NRC requirements by: (1) directing untrained individuals to use. moisture density gauges; i
(2) not providing these individuals with dosimetry while using the gauges; and (3) making '
false statements to the NRC. Furthermore, STL's President / Radiation Safety Officer (RSO) used the gauges without a valid NRC license.
On December 23,1998, STL requested an enforcement hearing. Further, during telephone discussions with the NRC, STL requested that the Order Suspending License be relaxed on I
the basis that certain commitments will be taken. Based on its review of the case, the staff concluded that the Order Suspending License may be rescinded provided that STL's commitments, and other conditions proposed by the staff, are incorporated into a Confirmatory Order Modifying License. STL consented to issuance of a Confirmatory Order.
Accordingly, a Confirmatory Order is being issued toaay, which requires,'in part, that:
_ (1) STL's President /RSO be replaced; (2) STL notify the NRC immediately if its old President /RSO attempts to influence the new President /RSO or any other STL employee in
_ the conduct of licensed activities; (3) STL fully cooperates with the NRC with regard to provision of complete and accurate records; and (4) STL retain the services of an independent individual or organization to perform audits ofits radiation safety program.
