CONFIRMATORY ACTION LETTER
Dear Mr. Smith:
On February 10,1998, the NRC was informod that you were inadvertently shipped a nuclear gauge from Pepsi-Cola Canada, Limited, tMt was intended for another location. Since you do not have an NRC license to possess the gauge, you were contacted by Heather Astwmi, of this office, on February 11,1998. Pursuant to that telephone conversation, it is our understanding that you have taken or will take the following actions which will be completed by the dates specified:
- 1) Ycu will restrict access by parsonnel to the industrial Dynamics Model FT 14 gauge in your possession as long es it contabs licensed material.
- 2) The licensed material (two 100 millicurie americium 241 sources) in your possession will be transferred to an authotized recipic.1t, by a consultant for Pepsi-Cola Canada, Limited, no later than February 20,1998.
Pursuant to Section 182 of the Atomic Energy Act,42 U.S.C. 2232, you are sequired to:
- 1) Notify me immediately if your understanding differs from that set forth above;
- 2) Notify me if for any reason you cannot complete the actions within the specified RIE*
schedule and advise me Irw ;ang of your modified schedule in advance of the changa; and Eiiiii,

- 3) Notify me in writing when you have completed the actions addressed in this R Confinnatory Action Letter. g, issuance of this Confirmatory Action Letter does not preclude issuance of an order formalizing M'
the above comr,1itments or requiring other actions on the part of the licenser.,, nor does it g*
preclude the NRC from taking enforcement action for violations of NRC requirements that may have prompted the issuance of this letter. In addition, failure to take the actions addressed in this Confirmatory Action Letter may result in enforcement action.
