SUBJECT:
REDELEGATION OF AUTHORITY PURPOSE:
To request Comission approval to allow redelegetion of my authority granted by the Comission under Section 145b of the Atomic Energy Act of 1954, as amended (AEA). Under this authority, I may approve the employment of an individual before the completion of a security investigation and report.
CATEGORY:
This is a minor policy issue requiring Commission consideration.
BACKGROUNQ:
Pursuant to a Commission vote on December 21. 1978, the Executive Director for Operations (EDO) was authorized to approve the employment of an individual before the completion of the security investigation and report required by Section 145b of the AEA as long as the individual was not permitted access to Restricted Data or National Security Information.
The Cortmission required that this authority be exercised only upon an affirmative recomendation from the Director. Division of Security, and a clear showing of need from the requesting organization.
The Comission further stipulated that this authority not be redelegated.

2 DISCUSSION:-
Inasmuch as the recently created position of Deputy Executive Director for Management Services (DEDM) now oversees both the Division of Facilities and Security (DFS) and the Office of Human Refources, it is appropriate that the DEDM be delegated the authority to approve employment requests pursuant to Section 145b of the AEA. This action is consistent with my goal to delegate authority for all personnel and security-related functions to the DEDM.
I have recently delegated to the DEDM the personnel security program responsibilities of the Senior Level Official under Executive Order 12968,
" Access to Classified Information" (Attachment).
The DEDM would not have redelegation authority for this function.
RECOMMENDATION:
That the Commission:
Authorize the EDO to redelegate to the DEDM the authority to approve the-employment of an individual before completion of the investigation and report required by Section 145b of the AEA.
This authority does not permit an individual to have access to Restricted Data or National Security Information.
Note:
Approval under Section 145b of the AEA will be granted only upon receipt a.
of an affirmative recommendation from the Director. DFS. and a clear showing of need by the requesting organization, b.
This authority may not be redelegated, c.
The Office of the General Counsel has no legal objection to thel recommended action.

SUBJECT:
DESIGNATION OF RESPONSIBILITIES UNDER EXCOUTIVE ORDERS 12958 AND 12968 The Deputy Executive Director for Management Services (DEDM) is designated as the NRC.
Senior Agency Official to fulfill ovciali agency responsibilities under E.O.12958, " Classified National Security Information." As the NRC Senior Agency Official, the DEDM has classification guide approval responsibilities under Section 2.3, certain declacsification responsibilities under Section 3, and general administrative program responsibilities under Section 5.6(c).
Additionally, pursuant to the provisions of Section 6.1.(a) of E.O.12968, "Acc.ess to Classified Information," dated August 2,1995, the DEDM is designated as the NRC Senior Agency Official to direct and administer the NRC's Personnel Security Program, incluc,ing active oversight and implementation of continuing security education and awareness programs, to ensure that E.O.
