SUBJECT: NRC COMBINED INSPECTION 50 336/97 84:50 423/97 84

On September 19,1997, the NRC completed an inspection at your Millstone 2 & 3 reactor

!

facilities. The enclosed report presents the resulte of that inspection.

As documented in the enclosed report, the implementation of your Unit 3 licensing

commitment to specify fire protection actions in the emergency procedures has been

ineffective. We also found your testing of fire-related safe shutdown components to be

inadequate, equipment testing had not been performed, equipment modifications had not

been completed. and that not all the safe shutdown modifications had been approved by

'

your Plant Operations Review Committee.

Our inspection also determined that your own audits found significant problems. We

agrend with the conclusions of your own Nuclear Oversight Audit Package

A24057/A1t5119,which stated "...there is a lack of attention to the Fire Pretection

Program at Millstone," arid further concluded "...it cannot be established that Unit 3 could

perform a safe shutdown."

We note that you have initiated corrective actions for a number of the fire protection

problerns you have identified, and that you still have some fire protection problems under

evaluation. These issues will be identified as unresolved matters in our report and will be

evaluated later under NRC's Enforcement Policy.

We found that you have taken several positive initiatives regarding the fire protection

program with the recent approval and issuance of the Unit 3 safe shutdown equipment

surveillance test procedures and the revised fire protection program manual.

The significant issues list item regarding fire protection will remain open pending an

additional alternate safe shutdown program review by NRC prior to unit start up.
