Dear Mr. Sepp:
i
SUBJECT:
REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC l
. DISCLOSURE, WESTINGHOUSE LETTER OF AUGUST 12,1997 l
By letter (OG 97-084) dated August 12,1997, the Westinghouse Owners Group (WOG) i submitted both proprietary and non-proprietary versions of material presented to the staff at a i
July 15,1997, meeting. In letter CAW 971148, dated August 4,1997, you requested the proprietary material be withheld from put4ic disclosure in accordance with 10 CFR 2.790. This is the response to that request.
in the affidavit dated August 4,1997, you stated that Westinghouse considered certain l
information proprietary and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790. The affidavit states that this information should be considered exempt from
- mandatory public disclosure for the following reasons:
(a)
The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.
(b)
Its use by a competitor would reduce his expenditure of resources or improve his i
competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.
[
We have carefully reviewed your August 4,1997, request and the !nfo.Tstion contained in your request. We have concluded that the submitted information sought to be wMhheld contains i
trade. secrets or proprietary commercial information. Therefore, the version of the submitted
~
information marked as propnetary will be withheld from public disclosure pursuant to i
10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
