SUBJECT: NRC INSPECTION REPORT No. 50 373/97016(DRP); 50-374/97016(DRP) AND

EXERCISE OF ENFORCEMENT DISCRETION

- Dear Mr. Subalusky - .

On October 31,1997, the NRC completed an inspection at your LaSalle facility. The enclosed

report presents the results of that inspecuon.

Dur,'ng this ikwook inspecuon, your condum of actMues at the LaSalle facility was generally

characterized as safe and in accordance with plant procedures. Your immediate corrective

actes to address equipment failures were appropriate, aM maintenance and survedlance

activities were performM acceptably. A particular perfoner ace strength noted during this

'ir'spection was your effective use of lessons loamed from previous activities and events in

effecting improvements in maintenance and cold weather preparations.

Based on the results of this inspection,- the NRC h.s determined that one violation of NRC

requissments occurred. The violation involved the failure to perform an adequate surveillance

test on the emergency diesel generators. However, the NRC is exercising enforcement

discretion and not issuing a Notice of Violation because the criteria specified in Section Vll.B.2,

"

' Violations identified During Extended Shutdowns or Work Stoppages," of the NRC Enforcement

Policy are satisfied. Specif;cally, the violation is based upon your activities prior to the events

leading to your decision in December 1996 to enter into an extended shutdown to address

longstanding performance issues. The violation would not have been categorized at Severity

Level 11, the violation was not willful, and enforcement action was not considered necessary to

achieve remedial action. In addition, actions specified in Confirmatory Action Letter Rill-96 008B '

,

effectively prevent you from restarting LaSalle County Station without implicit NRC approval.
